Terms & Conditions

By visiting our website, placing an order, or purchasing our products in person at events, you agree to this Agreement. By placing an order, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Customers under the age of 18 must have parent or guardian consent to place an order. At in-person events, a purchase made on behalf of a minor by a parent or guardian constitutes that adult’s agreement to these terms. Completing your order confirms you have read and accepted these terms.

1. Our Products

Magnet Fever LLC creates custom photo magnets and personalized keepsakes — online and at in-person events — including standard photo magnets, pet profile magnets (PetStory Memories), individual profile magnets, caption magnets, family/friendship magnets, memorial magnets, and gift magnets. Some products may not yet be available
and will be offered at a future date.

2. Your Responsibility for Submitted Information

All orders are custom-made to your specifications. You are solely responsible for ensuring that all information you submit is accurate and complete, including but not limited to photos, personalization details, product selections, and shipping information. This applies to all current and future products and services offered by Magnet Fever LLC. Magnet Fever LLC is not responsible for errors you submit. Orders produced from customer-submitted errors are not eligible for refund or replacement.

3. Photo Rights & Permissions

By uploading or submitting a photo, you represent and warrant that:

• You own the image or have explicit permission from the rights holder to use it for commercial printing.
• You have permission from any identifiable person shown in the image.
• For photos of minors (under 18), you are the parent/legal guardian or have their permission.
• The image does not violate any copyright, trademark, privacy, publicity, or other third-party rights.
• The image does not contain illegal, abusive, hateful, explicit, or otherwise inappropriate content.

You grant Magnet Fever LLC a limited license to use your images solely to fulfill your order. We do not claim ownership of your photos. You agree to indemnify and hold harmless Magnet Fever LLC from any third-party claims arising from images or information you submitted.

Do not upload professional studio photos, school portraits, celebrity images, or copyrighted artwork unless you have permission. We reserve the right to refuse such orders.

4. Image Quality & Cropping

Upload clear, well-lit, high-resolution photos centered on your main subject. Low-resolution, blurry, heavily filtered, or screenshot images may produce poor print results — we are not responsible for quality issues caused by the submitted image.

Magnets are produced to specific dimensions. Some cropping or repositioning may be necessary to fit the layout. Keep important subjects away from the edges of your photo. We are not responsible for content trimmed due to the original photo’s composition or dimensions.

5. Content Standards

We reserve the right to refuse, cancel, or request changes to any order — online or in person — that contains content that is illegal, hateful, harassing, explicit, abusive, defamatory, infringing, threatening, or otherwise inappropriate.

6. Production, Proofs & Timelines

Production typically begins within 1 business day of receiving all required photos, personalization details, and payment. Proofs are not automatically included; if offered, production does not begin until the proof is approved. Errors approved on a proof are considered final.

Timelines are estimates and not guaranteed unless stated in writing. Production times may be extended during high-volume periods such as holidays. We do not currently offer guaranteed expedited production unless specifically stated on the product page.

7. Cancellations

Cancellations are only accepted before production has begun. Because production typically begins within 1 business day of receiving all required photos, details, and payment, cancellation requests must be submitted immediately at hello@magnetfever.com with your order number. Once your order enters production, it cannot be canceled and no refund will be issued. In-person event sales are final at the time of purchase.

8. Shipping

You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, losses, or non-delivery caused by carriers, incorrect addresses, weather, holidays, or other circumstances outside our control. If a package is returned due to an incorrect address, you may be responsible for additional shipping costs. For packages marked delivered by the carrier but not received, contact the carrier directly; we will assist where possible but cannot guarantee replacement.

9. Color & Print Variation

Colors on your screen may differ from the final printed product due to monitor settings, lighting, and print materials.
Minor variations in color, brightness, texture, and finish are normal and are not considered defects.

10. Marketing & Reviews

We will not use your photos in advertising, social media, or marketing without your prior written consent. Your purchase does not grant us marketing rights to your images. If you submit a review or testimonial, you grant us a non-exclusive license to display it for business and promotional purposes.

11. Intellectual Property

All Magnet Fever LLC website content, product designs, templates, logos, graphics, and branding are our exclusive property. You may not copy, reproduce, distribute, or use any of our designs or content without written permission.

12. Payment

Orders are not processed until payment is confirmed. All prices are in U.S. dollars. We reserve the right to correct pricing errors, cancel affected orders, and refuse orders suspected of fraud. In-person event payments are due at the time of order.

13. Limitation of Liability & Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, MAGNET FEVER LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. OUR MAXIMUM LIABILITY FOR ANY ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER. PRODUCTS AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

14. Indemnification

You agree to indemnify, defend, and hold harmless Magnet Fever LLC and its owners, employees, and agents from any claims, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your use of our services, content or photos you submitted, or your violation of this Agreement.

15. Governing Law & Disputes

This Agreement is governed by the laws of the State of South Carolina. Any dispute arising from your order or use of our services — whether made online or at an in-person event — shall be submitted first to Magnet Fever LLC in writing at hello@magnetfever.com for informal resolution. If unresolved, disputes shall be brought exclusively in the state or federal courts of South Carolina. You consent to jurisdiction and venue in South Carolina.

16. Changes to This Agreement
We may update these Terms at any time. Changes take effect when posted with a revised date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Agreement.
